Legal Team Lead (Legal Director)

The Financial Sector Reform Activity (FSR) in Ukraine is a five-year program funded by the United States Agency for International Development (USAID) and managed by DAI Global LLC (DAI). The purpose of the activity is to transform the country’s financial sector into a sophisticated, well-functioning, competitive market that is aligned with European Union (EU) standards and integrated into international financial systems. This transformation will mobilize private finance for sustained economic growth in Ukraine.

FSR will be implemented through four interlinked components:

•COMPONENT 1: Market Regulation and Supervision

•COMPONENT 2: Financial Infrastructure

•COMPONENT 3: Private Sector Intermediaries and Facilitators

•COMPONENT 4: Transparency and Communications

The FSR project is looking for candidates to fill the Legal Team Lead (Legal Director) position.

Responsibilities:

The Legal Team Lead (Director) will manage the work of FSR’s financial sector legal team. The legal/regulatory team will develop the modern and EU compliant legislation for financial markets (banking, capital and commodities markets, NBFis, consumer protection) and support its implementation. S/he will be responsible for providing analysis of financial market legal issues, reviewing the legal work of associates, interacting with partners and counterparts on project legal issues, and participating in the development of project strategy.

Other tasks include:

     •   Design and support legal/regulatory technical assistance interventions and measures to move Ukraine to EU and international standards for financial markets.

     •   Support GOU policy makers, financial regulators, private market actors, and civil society organizations in their efforts to reform, streamline and modernize the financial sector.      

     •   Support the development of a robust legal/regulatory framework for capital and commodities markets.

     •   Support the approximation of the Ukrainian legislation with EU Directives.

     •   Lead FSR’s work legal and regulatory reviews, analysis, preparation of concept papers, road maps, implementation plans, MoUs, presentations, and other documents. 

     •   Provide input on policy response and emergency response to address the challenges that the citizens of Ukraine face as consumers of financial services.

     •   Support implementation of the legislation on digital finance, virtual assets and the development of digital finance solutions.

     •   Support coordination and communication of relevant stakeholders of the financial sector, including participation in working groups, meetings and discussions; engage key industry stakeholders including regulators, other donors, civil society organizations, industry associations and the private sector.

     •   Engage with other U.S. agencies (SEC, CFTC, US Treasury, DFC) and with other USAID projects, and international donors, such as IMF, WB, EBRD, EU Delegation, IFC, to enhance collaboration and leverage resources and technical assistance.

     •   Manage the legal team, including tasks distribution and quality control.

     •   Support other components of the Project with legal expertise.

     •   Participate in senior staff meetings, debriefings for the management. 

     •   Provide feedback, highlights and reporting to USAID.

Required Qualifications:

     •   University degree in law; Master’s degree or PhD preferred.

     •   Knowledge of Ukrainian financial sector legislation, minimum ten to fifteen years work experience.

     •   Solid project management skills – minimum 7 years’ managerial experience.

     •   Understanding of the legal and regulatory framework of the European Union, relevant EU Directives, experience in approximation of the Ukrainian legislation with that of the EU.

     •   Experience with IFIs/donor organizations is a plus.

     •   Experience with research, writing analytical/assessment reports.

     •   Strong communication and presentation skills.

     •   Excellent oral and written English and Ukrainian skills.
