The Energy Security Project (ESP) is a five-year project funded by the United States Agency for International Development (USAID),[1] implemented by Tetra Tech, a California-based leading provider of services in the areas of water, environment, infrastructure, resource management, energy, and international development.[2]

The ESP mission is to enhance Ukraine’s energy security, to improve the energy legal and regulatory environment in the country, and to increase the resilience of Ukraine’s energy supply. This will help to support country’s economic development and sustain its democracy. ESP is working closely with the Government of Ukraine (GOU) to develop competitive energy markets. By doing so, ESP will facilitate private sector-led energy investments to provide affordable, reliable, resilient, and secure energy for all Ukrainians.

Summary:

Tetra Tech is looking to fill in a short-term consultancy position of Lawyer, who will work on the following assignment: «The unification (standardization) of terminology used in the legislation of Ukraine, creation of the glossary of terms and conditions in the oil and gas sector». Private Entrepreneur Status or Attorney in Law (Advocate) Status is required. Expected period of performance is 3 months.

Tasks:

Analysis of legislation in the oil & gas sector with respect to definitions and terminologies used in Ukraine vs. Europe. The task is to identify discrepancies in the terminology, used for oil & gas during production, supply (trading, transmission), distribution. The glossary of terms and conditions should be harmonized with the standard definitions provided by the EU.

Position responsibilities:

  • Reviewing legislation, compiling a list of terms that require clarification and introduction;
  • GAP analysis between Ukrainian terminology and definitions used in oil and gas and EU terminology and definitions. (to be approved by ESP and necessary governmental stakeholders);
  • Action plan for adoption of the glossary of terms and conditions to bring Ukrainian terminology and understanding to harmonize with EU terminology and understanding;
  • Participation in the Meetings, where necessary, to align with ESP and governmental stakeholder to facilitate the adoption of the terminology;
  • Preparation of necessary package of documents for adoption of the glossary of terms and conditions to be submitted to Government;
  • Preparation of the report on definitions and proposals in English and Ukrainian (as result of work).

 

Essential KSA’s required (experience, skills, education, certification, etc.):

  • Master’s or bachelor’s degree in Law or Energy Law;
  • Proven experience in drafting, negotiating and reviewing legal documents, legislative acts, memoranda etc.;
  • Experience with gas sector activities;
  • Fluency in Ukrainian and proficiency in English (written and spoken) with proven expertise in gas industry and regulatory agency terminology;
  • Proficiency in office computer applications (Microsoft Word, Outlook, Excel, PowerPoint);
  • Able to communicate complex information and deliver verbal and written messages effectively;
  • Strong research capabilities, using a variety of primary and secondary sources.
