In response to the request of the Government of Ukraine, UNOPS opened an office in Ukraine in 2017, which provides a broad spectrum of services to the Government and the people of Ukraine. Currently, the office is classified as an Operations Centre, with a portfolio of projects exceeding USD 100 million in the areas of rule of law, environment, energy efficiency, crisis recovery, good governance, human resources management, procurement and logistics.
The European Union funded Project ‘Support for Rule of Law Reforms in the Areas of Police, Public Prosecution and Good Governance’ (hereinafter - Project) has the overall objectives of supporting the strengthening of policing, prosecution and civilian governance in Ukraine and to align them with the best European and International practices. On matters of substance, the project relies on the EU Advisory Mission (EUAM) Ukraine.
The Project supports the creation of an efficient law-enforcement system, respectful of human rights, through the provision of necessary support to the Ministry of Internal Affairs, the National Police of Ukraine, the State Bureau of Investigations, the Office of Prosecutor General (OPG).
The current assignment relates to the scope of the Project’s support measures for the OPG, aligned with the Justice Sector Reform Strategy, the Justice Reform Action Plan for 2015-2020 and directly supports implementation of priority areas of prosecutorial reform identified by the OPG in October 2019. In particular, the intervention will include provision of expert support for the analysis of the current disciplinary practice for prosecutors and observance of standards of ethics and professional conduct by prosecutors. This is intended to result in recommendations for possible improvements and enforcement of existing procedures and mechanisms while striving to ensure full compliance with the best EU practices and international standards.
This activity should contribute to implementation of recommendations of the latest available version of the GRECO[1] report on Ukraine.
Purpose and Scope of Assignment
Under the supervision of the Programme Manager and in coordination with the partners (the OPG, EUAM) the Specialist on Disciplinary Actions and Ethics in Prosecution (hereinafter - Consultant) will be responsible for providing the following deliverables.
1. Analysis of the current state of play on observation of standards of disciplinary actions for prosecutors in Ukraine.
As the main deliverable for this stage, the Consultant will provide practical advice to the OPG in the process of developing a permanent disciplinary procedure. Recommendations of the analytical reports on disciplinary proceedings developed by other partners should be taken into consideration.
Special attention should be paid to recommendations of the GRECO Fourth Evaluation Report (including GRECO report of 2020, if available) and the status of their implementation in
2. Analysis of the current version of the Code of Prosecutorial Ethics and Professional Conduct (hereinafter – the Code), and recommendations for enhancement of its provisions and implementation.
The Consultant will analyze the documentation of the OPG and QDCP, which will be made available by the OPG, to identify the most common cases of violation of ethical rules by prosecutors and solutions and means to prevent them.
3. Analysis of the factors causing gross breach of prosecutorial ethics, such as corruption.
4. Analysis of the existing General Inspection system and recommendations on improving its efficienc
